Contact Lens Online Terms of Trade

Thanks for visiting us at Contact Lens Online. We've got a few rules when it comes to buying contact lenses from us, but we've tried to keep them pretty simple and straightforward.

For the sake of brevity, he's some short hand references we'll use from here on out.

Contact Lens Online = Supplier. Customer = You.

Rule #1: Accepting Terms and Conditions
By creating an account and using this web site, you are accepting these terms and conditions. If you do not accept these terms and conditions, you must refrain from using our online services.

You acknowledge and agree that all information given to the Supplier is true and accurate. The Supplier does not accept responsibility (including but not exclusive to loss of money, time, effort) for any consequences of false or mistaken information provided by you, the Customer.

Rule #2: Valid Contact Lens Prescription
You hereby agree that you have a valid prescription that is current and not older than 24 months since it was issued by a registered Optometrist for the contact lenses that you are purchasing. This means that you have attended all appointments and follow up appointments as recommended by your optometrist. You also certify that all the information supplied to us exactly matches the prescription given to you by your Optometrist or eyecare provider.

You agree to follow your eyecare provider's advice regarding the use and handling of the contact lenses as prescribed. Not withstanding the recommendations of the contact lens manufacturer you agree to adhere to the wearing regime as recommended by your eyecare provider. You agree to stop wearing the contact lenses and seek immediate advise of an eyecare provider if your vision or the appearance of your eyes is not normal. Should it be deemed necessary you give consent to us to verify your prescription and any other information relating to your eyes. We will however contact you beforehand and you may retract your consent at that stage, which allows us to terminate your contact lens order.

If you wish that Contact Lens Online help check this prescription information, either enter the name of your optometrist during check-out or reply to your order confirmation email with a scan of your prescription attached.

Contact Lenses can be harmful to your eyes
You understand that using contact lenses improperly, or using contact lenses that are not prescribed for you, may result in harm or damage to your eyes or vision. You agree to visit your optometrist as regularly as advised, this is normally at least once per year. If any problems occur such as pain or discomfort, you must remove your contact lenses immediately and consult your optometrists, or eye specialist. You should never wear contact lenses if you suspect you may have an eye infection.

Rule #3: Order Cancellation
Contact Lens Online reserves the right to cancel any orders. Reasons for cancellation may include, but are not limited to:

  • Inappropriate use of the Contact Lens Online shopping site,
  • Situations where we believe payment details may be fraudulent
  • Insufficient information is provided for us to process the order.

If you order is cancelled, you will be notified by email and you will not be charged.

Rule #5: Termination of Your Account
Contact Lens Online reserves the right to suspend or delete your user account if we have reason to suspect that you have breached any of the terms or conditions.

Rule #6: Accurate Information
You agree that all information provided when ordering and creating your account is correct. It is your responsibility to ensure your details are up to date when placing an order. You may not to register under multiple identities. Contact Lens Online may delete additional accounts that we believe belong to the same person.

Rule #7: Jurisdiction
All parties agree that New Zealand courts will be vested with jurisdiction in the event of any dispute arising from this agreement or use of this web site.

Rule #8: Applicable Law
All parties agree that this agreement is governed by the law of New Zealand and that the law of New Zealand will apply to any dispute arising from this agreement or use of this web site.

Rule #9: Shipping and Delivery
To delivery your contact lens purchases, we are using overnight courier deliveries (mostly by trusty NZ Post) within New Zealand. The delivery times given for the different delivery methods are approximate and can vary depending on how fast those delivery vans are getting through traffic. Smoko breaks can hamper delivery times quite a bit, but we've got to give these guys a break sometimes. We strive to process your order the same day in order to get your purchase into your hot little hand as soon as humanly possible.

If the item is in stock then the delivery will normally be shipped next day, if not earlier. For non-stock products delivery can vary, but the estimated delivery times are clearly marked in the product details section for each product and in the Delivery Information section. Sometimes a particular item may have to be ordered in which can take a lot longer. If your item has to be ordered in we will notify you and you can cancel the order without penalty if you wish, refunding any money you have paid. We will deliver to a PO BOX if at all possible. We deliver to New Zealand addresses only at this time. International deliveries are not available at this point in time. Additional delivery charges will apply for rural deliveries.

Contact Lens Online's responsibility for courier deliveries "without signatures required" ends, when the courier Track & Trace report clearly states that the parcel has been delivered at the address provided by you. From there, it's all up to you! All responsibility for receiving the parcel lays with you, the customer. We will provide you with evidence about the tracked courier number and date of dispatch if need be. Contact us if you are having troubles with your delivery and we'll sort it out for you, pronto.

Rule #10: Returns
Any item that you are not happy with must be returned within 14 days. The item must be undamaged, unopened and must reach us in its original condition and in its original packaging. You are responsible for the cost of returning the item to us unless we processed the order incorrectly. If the goods are faulty or incorrectly shipped you need to contact us within 14 days and we will send a pre-paid courier pack in which you can return the goods. Once you have returned the goods you can get a full refund or a credit. We will either refund you by the same method in which you paid (including shipping), or apply a credit to your account.

Rule #11: Pricing
All prices for both products and delivery are in New Zealand dollars (NZD) and include Goods and Services Tax (GST). Prices may change from time to time without warning at our discretion.
